Fluffernutter Kerfuffle

Nearly 90 years ago, World War I veterans H. Allen Durkee and Fred L. Mower returned from the Western Front and bought the secret formula for Marshmallow Fluff. Today, the Massachusetts company they founded, Durkee-Mower, is going to the trenches again, this time in a fight with Williams-Sonoma. The company has sued the upscale kitchenware retailer, accusing it of improperly using the name 'Fluffernutter' to describe a marshmallow/peanut butter/chocolate treat it sells through its Web site and catalog. Durkee-Mower claims Fluffernutter is its own registered trademark and is seeking unspecified damages. 'Williams-Sonoma has no right to trade on our hard-earned reputation with their so-called Fluffernutter confection,' the company said in a release.
